Terms and Conditions for PickupText SMS Messaging Service

Welcome to the PickupText SMS messaging service! These Terms and Conditions ("Terms") govern your use of the PickupText SMS program. By opting in to receive SMS messages from PickupText, you agree to these Terms.

1. Program Details:

• Program Name: PickupText
• Product Description: PickupText provides SMS messaging services for businesses to communicate with their customers, including, order status, account updates, and other relevant information.
• Message Frequency: Message frequency may vary.
• Customer Care Contact Information: You can contact our customer support team at support@pickuptext.com or 1-888-411-9113
• Opt-Out Information: You can cancel the SMS service at any time. Text "STOP" to the SMS number to opt-out. After you send the message "STOP" to us, we will send you a reply message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
• "Message and data rates may apply" disclosure: As always, message and data rates may apply for any messages sent to you from us and to us from you. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
• PickupText liability: PickupText is not liable for and legal or financial ramification due to delayed or undelivered messages.
• Supported carriers: Carriers are not liable for delayed or undelivered messages.

2. Call-to-Action and Opt-In:

Text by providing your phone number and opting in to the PickupText SMS messaging service, you consent to receive SMS messages from PickupText as described above. Your consent is not a condition of purchase.

Example Call-to-Action Opt-In by Inbound Message Flow:

1) First message is always sent by the customer contacting the business to provide implied consent. Channel is on-premises from a flyer. The customer will verbally opt-in during a conversation with one of our service representatives, who will ask if they would like to receive text messages from our company.

2) The customer opts in by texting a designated phone number, this provides implied consent the system responds with:

"Thank you for opting in to PickupText SMS order updates! Msg freq may vary. Std msg & data rates apply. Reply STOP to opt out, HELP for help."

Reply STOP to opt−out.

When the user texts "STOP" the system responds with:

"You have successfully been unsubscribed. You will not receive any more messages from this number. Reply to resubscribe."

Reply HELP for help.

When the user texts "HELP" the system responds with:

"For help visit our site. Privacy Policy https://www.pickuptext.com/privacy-policy & Terms https://www.pickuptext.com/terms"

3. Use of Service:

You agree to use the PickupText SMS messaging service only for lawful purposes and in accordance with these Terms. You are responsible for ensuring that your use of the service complies with all applicable laws and regulations.

4. Content:

PickupText is not responsible for the content of messages sent through the service by our business users. However, we reserve the right to investigate and take action against any user who violates these Terms or uses the service for illegal or abusive purposes.

5. Changes to Terms:

PickupText may modify these Terms at any time. We will post any changes on our website at www.pickuptext.com. Your continued use of the SMS service after any such changes constitutes your acceptance of the new Terms.

6. Termination:

We may terminate your access to the PickupText SMS messaging service at any time, with or without cause.

7. Disclaimer of Warranties:

The PickupText SMS messaging service is provided "as is" and without warranty of any kind. We do not guarantee that the service will be uninterrupted or error-free.

8. Limitation of Liability:

In no event shall PickupText be liable for any damages arising out of or in connection with your use of the SMS messaging service. PickupText and/or Carriers are not liable for delayed or undelivered messages.

9. Governing Law:

These Terms shall be governed by and construed in accordance with the laws of New York State.

Changes to these Terms and Conditions

We reserve the right to make corrections or updates to this Terms and Conditions at our sole discretion from time to time. When we do so, we will post the updated Terms Notice on our website and update the Terms and Conditions effective date. We encourage you to periodically review this Terms and Conditions published on our website.
